A 24-year-old soldier who fled to Canada after serving in Iraq has been released by U.S. military officials and won't face a court martial, his lawyer said Friday.
Jim Fennerty told the Lexington Herald-Leader in Kentucky that Darrell Anderson would be on extended leave for a month and then would receive a discharge other than honourable.
Anderson returned to the Fort Knox, Ky., base Tuesday after spending nearly two years in Canada.
"I feel that by resisting I made up for the things I did in Iraq," he said upon his return. "I feel I made up for the sins I committed in this war."
Anderson returned to Kentucky with his wife, Gail Greer of Timmins, Ont.
He served seven months in Iraq with the 1st Armoured Division, a stint that included guarding police stations in Baghdad. He received a Purple Heart after being wounded by a roadside bomb.
Anderson grew disillusioned with the war and has said he did not receive adequate emotional counselling after being injured.
When ordered to redeploy to Iraq he fled across the border at Niagara Falls in January 2005, before settling in Toronto.
Anderson attempted to file a refugee claim to remain in Canada, but missed an application deadline.
I really disagree with his decision to desert but I am happy that they released him.

Well he tried to get help and was let down by his superiors from what it sounds like. In that case he felt no choice but to desert. I would blame the officers who treated him like ****.

Because it takes a year to process it, and the service uses an illegal gotcha clause to trip up soldiers.
Other abuses can be found here and at IVAW. Its not a good time to be a service member as you are being treated like **** and sent to die for no purpose other than to fatten Cheney's pockets.

I'm fully aware that it takes a year to process but you should still use all avenues at your disposal before deserting. Just for the reason that you might lose your VA and college benefits if you frak off. Not to mention that your leaving your buddies in the lurch. I hate this war as much as the next guy but deserting really fraks your life over.

Basically a trick question that goes like this.
"Say your base is being overrun and you see the enemy butchering your wounded buddies. Do you pick up a gun and shoot them to protect your wounded buddies?"
If the answer is yes, your request is denied even though CO status does allow you to defend yourself and others in such a circumstance.

I thought people with CO status weren't deployed though? If so the question is just there to frak you over.

CO means you are in a non-combat position upon deployment.
